These Terms and Conditions govern the use of the website available at retiva.io and related voucher sales pages (the “Service”).
The Service is operated by:

(“Operator”, “Retiva.io”, “we”, “us”).
1. Definitions
- Operator – MS Quality Maria Szruba, owner of the Service.
- Venue / Seller – a restaurant (or other business) offering vouchers for purchase via the Service and responsible for honouring them.
- B2B Customer – a person acting on behalf of a Venue, using the merchant tools (panel, voucher page, reports).
- Buyer / Customer – a person purchasing a voucher (consumer or business customer).
- Voucher – a monetary-value voucher (“gift card”) redeemable at the Venue under the terms shown on the Venue’s voucher page.
- Service – the website retiva.io and all related subpages and voucher sales pages hosted under the retiva.io domain.
2. General provisions
- These Terms define the rules for using the Service, including purchasing Vouchers and using the merchant panel.
- Using the Service is equivalent to accepting these Terms.
- The Operator may update these Terms. Updated Terms are effective from the date of publication on the website.
3. Nature of the Service
- Retiva.io provides a technical platform that enables Venues to sell gift vouchers to Buyers online.
- The Operator is not a party to the contract for the sale of the Voucher. The contract is concluded directly between the Buyer and the Venue.
- The Venue is solely responsible for accepting and honouring the Vouchers it offers.
- The Operator is not liable for the Venue’s failure to honour a Voucher, insolvency of the Venue, or any disputes between the Buyer and the Venue.
4. Purchasing a voucher (B2C)
- Vouchers are sold by Venues, not by the Operator.
- The Buyer selects a Venue’s voucher page, chooses an amount/type, and completes an online payment.
- Upon successful payment, the Buyer receives a Voucher by e-mail with a unique code.
- The Voucher is valid for the period stated on the Venue’s voucher page (minimum 12 months from date of purchase, as required by Polish law for monetary-value vouchers, unless the Venue sets a longer period).
- Vouchers are not redeemable for cash.
- The Buyer is a consumer under Polish law. Statutory consumer rights apply where applicable.
5. Right of withdrawal (consumers)
- Under EU Directive 2011/83/EU and Polish Consumer Rights Act, the right of withdrawal from a distance contract does not apply to vouchers where the service has been fully performed with the consumer’s prior express consent.
- By completing the purchase, the Buyer expressly requests immediate delivery of the Voucher and acknowledges that the right of withdrawal is thereby excluded once the Voucher has been delivered.
- If the Voucher has not been used and has not been delivered, the Buyer may request cancellation by contacting the Venue directly within 14 days of purchase.
6. Complaints (B2C)
- Complaints regarding the purchase process (payment, Voucher delivery) should be sent to: info@retiva.io.
- Complaints regarding Voucher redemption at the Venue should be addressed directly to the Venue.
- The Operator will respond to complaints within 14 calendar days.
7. B2B Customers (Venues)
- A Venue wishing to use Retiva.io must register and accept these Terms and any additional B2B agreement or pricing terms provided separately.
- The Venue is responsible for: the accuracy of its voucher page content, fulfilment of sold vouchers, compliance with applicable tax and consumer protection laws.
- The Operator may suspend or terminate a Venue’s account in case of breach of these Terms or applicable law.
8. Payments
- Payments are processed by a third-party payment provider (e.g. Stripe). The Operator does not store card data.
- Transaction fees may apply, as described in the B2B agreement with the Venue.
9. Intellectual property
The Service, its design, logos, and content are the property of the Operator or its licensors. You may not reproduce or use them without written permission.
10. Limitation of liability
To the maximum extent permitted by applicable law, the Operator’s liability is limited to direct damages actually caused by the Operator’s proven fault, and shall not exceed the fees paid by the B2B Customer in the preceding 3 months.
11. Governing law and disputes
- These Terms are governed by Polish law.
- Disputes between the Operator and B2B Customers shall be resolved by the court competent for the Operator’s registered address.
- For consumers, mandatory consumer protection provisions of the consumer’s country of residence also apply.
- EU consumers may use the ODR platform: https://ec.europa.eu/consumers/odr/.
